        a. This Steel Staker tool is warranted for 60 days against defects in materials or workmanship affecting its structural integrity. Except for this limited warrantee, we make no warrantee on any kind, expressed, or implied, including without limitation any warrantee of merchantability or fitness for any particular purpose. Abuse, misusing, bending or modifying of this stake driver will void all warrantees and subsequent liability.

         b. In the event this tool proves to be defective, we will either repair or replace the defective part or refund the purchase price with the presentation of a sales invoice at our discretion only if you send the failed tool postage prepaid to the address provided in this instruction sheet. IN NO EVENT SHALL WE BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER CAUSED BY A DEFECT IN THE TOOL OR OTHERWISE, OR ANY AMOUNT IN EXCESS OF THE ORIGINAL PURCHASE PRICE. Some states or jurisdictions do not allow the exclusion or limitation on incidental or consequential damages, or allow limitations on how long an implied warrantee lasts, so the above limitation or exclusion may not apply to you. This warrantee gives you specific legal rights, and you may also have other rights, which may vary from state to state.
